In Ontario, the process of divorce can be emotionally challenging and financially daunting. Court Fees

Filing for divorce in Ontario involves court fees, which are non-negotiable expenses. These fees cover administrative costs associated with processing the divorce application and vary depending on the specific documents filed. As of March 2024, the basic court fee for filing a divorce application in Ontario is $669, payable in two installments of $224 and $445. The first payment of $224 is payable at the time of filing the application, and the second payment of $445 is due at the time of setting the matter down for a divorce hearing.

 

Additionally, if any amendments or additional motions are required during the course of the divorce proceedings, additional court fees may apply. This may occur when the party initiating the simple divorce application (filed by one party where no other issues are being contested) cannot locate the other party; a motion for substituted service of the divorce application by another mode may be required. In a joint divorce (filed by both parties together), where parties have already reached an agreement, the need for such amendments is minimal, thereby reducing associated costs.

Legal Fees

These fees typically vary based on the complexity of the case, the experience of the lawyer, and the specific services required. For a simple divorce application, the fees are relatively lower as it entails standard document drafting and preparing. In a joint  divorce, where both parties negotiate  key aspects such as asset division, child custody, and support, legal fees tend to be lower than contested divorces but may still be higher when compared to simple divorces. This is due to the associated costs in negotiating the issues before proceeding with divorce. 

Lawyers may charge either an hourly rate or a flat fee for handling a divorce case. In the case of a simple divorce, where the process is streamlined due to mutual agreement, lawyers often offer flat-rate packages, providing clients with predictability in terms of costs.

Securing a divorce in Ontario need not entail exorbitant costs. At Nazarian Law, we are dedicated to offering cost-effective solutions for divorces and associated legal services. For uncomplicated divorce proceedings, we refrain from billing on an hourly basis. Conversely, in cases of contested divorces and the negotiation of separation agreements, our fees are calculated per hour. However, we do extend fixed-rate options for specific phases of cases to eligible clients. We acknowledge the emotional gravity of divorce proceedings, and endeavor to mitigate concerns regarding undisclosed expenses and unanticipated legal charges.

Our flat fee for a simple divorce encompasses several key components essential to your divorce proceedings. Priced at $2200 plus HST, this fee covers various aspects, including:

  • Information gathering
  • Drafting your application and supporting documents
  • Filing your application with the court
  • Arranging service of your spouse through regular mail or personal service, inclusive of process server fees
  • Communication with the court in case of any file-related issues, as well as direct communication with you, the client.

It’s important to note that this flat fee incorporates the mandatory court fees amounting to $669. However, certain additional expenses are not covered within this flat rate. These include:

  • Costs associated with service on your spouse residing outside Ontario (subject to additional rates of process servers in that jurisdiction).
  • Expenses related to substituted service, which may arise if we are unable to locate your spouse, necessitating a motion to be filed to seek the court’s permission to serve via alternative means (e.g., email).
  • The fee for obtaining a certificate of divorce, required should you intend to remarry.

We prioritize transparency and strive to ensure clarity regarding all potential costs associated with your divorce proceedings.

Please note: Our flat fee option is for the process of simple divorce only. Should you require our services to negotiate on other issues leading to a separation agreement or if the matter is in court, our hourly rates will apply. Once a separation agreement has been executed or a final court order is issued settling all ancillary issues in your case, our flat fee rate will apply for your divorce. 

Mediation and Dispute Resolution

While uncontested divorces generally involve minimal conflict, some couples may benefit from mediation or alternative dispute resolution mechanisms to address any remaining issues amicably. Mediation can help facilitate communication and negotiation between parties, potentially reducing the need for litigation.

Mediation fees (payable to the mediator), if applicable, represent an additional cost but can ultimately result in savings by avoiding prolonged court battles and legal fees associated with contentious divorces.

Additional Expenses

Depending on the circumstances surrounding the divorce, there may be additional expenses to consider. These may include fees for valuation of assets, parenting assessments, or independent legal advice for specific matters.

It’s essential for individuals to discuss potential additional expenses with their lawyer and factor them into their overall budget to avoid unexpected financial burdens during the divorce process.
